Access to and use of the Aestiora platform constitutes your unconditional acceptance of these Terms of Use and our Open License. If you do not agree to any of these terms, you must immediately cease all use of the platform and its content. These Terms apply to all visitors, users, and any other parties who access or use the platform.

Subject to these Terms, Aestiora grants you a worldwide, non-exclusive, royalty-free license to download, copy, modify, distribute, perform, and use images obtained from the platform for lawful personal and commercial purposes, in accordance with the Aestiora Open License. This license does not extend to the platform itself, its design, its AI evaluation model, or any written content — only to the photographic images made available for download.

You agree not to use the platform to engage in any activity that is unlawful, harmful, harassing, defamatory, or otherwise objectionable. Specifically, you may not: deploy automated scrapers, bots, or crawlers to mass-download content in a manner that impairs platform performance or availability; attempt to circumvent any security, access control, or rate-limiting measures we implement; use the platform in a manner that infringes the rights of any third party, including intellectual property rights; or misrepresent yourself or your intended use of downloaded images.

The aesthetic and use-case scores displayed on Aestiora are generated by an automated AI evaluation system using a large vision-language model. These scores represent computed assessments based on the model's learned visual priors — they are not professional certifications, nor do they reflect the subjective aesthetic judgment of any human expert. Known limitation: the underlying model tends to favor high-saturation and high-dynamic-range imagery, producing elevated scores for these visual characteristics regardless of how scoring prompts are formulated. This is a characteristic of the model architecture, not a deliberate design choice. Users are solely responsible for evaluating images for their own intended use, and should use the individual dimension scores — not just the overall score — to find imagery that matches their specific needs.

The Aestiora platform, including its design system, AI evaluation model, scoring methodology, visual attribute taxonomy, and all written content, is the intellectual property of Aestiora and its licensors and is protected by applicable copyright, trademark, and other laws. These Terms grant you no right, title, or interest in the platform itself. Aestiora makes no claim of copyright ownership over the underlying photographic works made available for download — rights in those works remain with their respective photographers or have been released to the public domain.

The platform and all content — including images, AI scores, and metadata — are provided "as is" and "as available" without warranty of any kind, express or implied. Aestiora expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Aestiora does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components, nor that any AI score, metadata, or license status information is accurate, complete, or current.

To the maximum extent permitted by applicable law, Aestiora and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising from or related to your use of or inability to use the platform or its content, even if Aestiora has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, Aestiora's liability is limited to the fullest extent permitted by applicable law.

Aestiora reserves the right to modify these Terms of Use at any time and at its sole discretion. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the platform following the posting of any changes constitutes your binding acceptance of those changes. We encourage you to review these Terms periodically. If you disagree with any revised Terms, your sole remedy is to discontinue use of the platform.

These Terms of Use are governed by and shall be construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the competent courts in Aestiora's jurisdiction of incorporation. If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
